These terms govern your use of darwintech.ai and any messages you exchange with Darwin Tech Solutions LLC ("Darwin.Tech", "we", "us"). By using this site or messaging us, you agree to them.
1. What we do
Darwin.Tech designs and builds automation and AI systems for professional service firms. Nothing on this website is an offer to enter a contract. Engagements are governed by a separate written agreement signed by both parties, and that agreement controls if anything here conflicts with it.
2. SMS terms of service
The following terms apply to text messages sent by or on behalf of Darwin Tech Solutions LLC.
- Program name
- Darwin Tech Solutions client messaging.
- Program description
- We send service-related messages to prospective and existing clients. These include conversational replies to enquiries, appointment and consultation confirmations and reminders, project and service updates during an active engagement, follow-up after an appointment or a completed engagement, and occasional requests for feedback or a review. We do not send promotional offers or advertisements under this program.
- How to opt in
- You opt in in one of two ways: (1) by sending us a text message at the number published on this website, or by giving verbal consent during a call with us; or (2) by agreeing, in a signed service agreement with us, to receive service-related text messages about your engagement. The consent language in that agreement appears immediately above the signature line and is not pre-checked or bundled with unrelated terms. We do not purchase, rent or otherwise obtain phone numbers from third parties.
- Message frequency
- Message frequency varies and depends on your interaction with us. If you contacted us with an enquiry, you will typically receive messages only in response to your own. If you are an active client, you may also receive appointment and project messages related to your engagement — typically no more than a few messages per week.
- Message and data rates
- Message and data rates may apply. Any charges are billed by, and payable to, your mobile service provider. We do not charge for messages.
- How to opt out
- Reply STOP to any message at any time. You will receive a single confirmation and no further messages. You can rejoin at any time by texting us again.
- How to get help
- Reply HELP to any message, or email hello@darwintech.ai. We respond within one business day.
- Carriers
- Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier and device.
- Supported carriers
- AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, U.S. Cellular, MetroPCS and others.
- Privacy
- See our Privacy Policy. No mobile information is shared with third parties or affiliates for marketing or promotional purposes, and text messaging opt-in data and consent are never shared with any third party.
3. Not professional advice
Darwin Tech Solutions LLC is a technology company. We are not a law firm and we do not provide legal advice. Nothing on this site, in our messages, or in our systems creates an attorney–client relationship. Nothing here is medical, legal, financial or compliance advice, and it should not be relied on as a substitute for advice from a qualified professional.
Where our work touches regulated data, our clients remain responsible for their own regulatory obligations. We support compliance through written agreements; we do not assume our clients' duties.
4. Acceptable use
You agree not to use this site or our messaging to: break the law; interfere with or disrupt the site; attempt unauthorised access to any system; scrape or harvest data by automated means; or transmit malware. We may suspend access for anyone doing so.
Please do not send us confidential, privileged, health or other sensitive information through the website form or by text message. Those channels are for initial contact only.
5. Intellectual property
The content, design, code and marks on this site belong to Darwin Tech Solutions LLC and are protected by intellectual property law. You may view and share pages for your own business evaluation. You may not copy, republish or create derivative works without our written permission.
6. Third-party links and services
This site links to third-party services, including our scheduling calendar. Those services have their own terms and privacy practices, and we are not responsible for their content or conduct.
7. Disclaimers
The site is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. Statements about outcomes reflect past results for specific clients and are not a promise of what your firm will achieve.
8. Limitation of liability
To the fullest extent permitted by law, Darwin Tech Solutions LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues or data, arising out of your use of this site or our messaging. Our total liability for any claim relating to this site or our messaging will not exceed one hundred US dollars (US $100). Nothing in this section limits liability that cannot be limited by law. Liability under a signed engagement agreement is governed by that agreement, not this section.
9. Indemnity
You agree to indemnify and hold harmless Darwin Tech Solutions LLC from any claim arising out of your misuse of this site or your violation of these terms.
10. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
11. Changes
We may update these terms. The "last updated" date above will change, and continuing to use the site after an update means you accept the revised terms.
